In compliance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016, on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (hereinafter, GDPR), and Organic Law 3/2018 of 5 December on the Protection of Personal Data and the guarantee of digital rights (hereinafter, LOPDGDD), ZENIFICA, S.L. (hereinafter, the Data Controller) informs users of the website colindar.com about the processing of their personal data.

Personal data collected through the forms on this website will be processed for the following purposes:

  • Managing information requests, enquiries and contact made by users.
  • Managing free demo requests for Colindar App.
  • Providing the services contracted through the Colindar App platform.
  • Sending commercial communications about our products and services, provided that the user has given their explicit consent.
  • Managing technical support requests.
  • Complying with applicable legal obligations.

3. Legal Basis for Processing

The legal basis for the processing of your personal data is:

  • Consent of the data subject (Art. 6.1.a GDPR): for sending commercial communications and processing data through contact forms.
  • Performance of a contract (Art. 6.1.b GDPR): for the provision of Colindar App services contracted by the user.
  • Legitimate interest of the controller (Art. 6.1.f GDPR): for internal management and the improvement of our services.
  • Compliance with a legal obligation (Art. 6.1.c GDPR): for compliance with tax and commercial obligations.

Personal data may be disclosed to:

  • Competent public authorities, in the cases provided for by law.
  • Service providers necessary for the provision of our services (hosting, email, CRM, etc.), with whom the corresponding data processing agreements have been formalised.

No international data transfers are made outside the European Economic Area, except those necessary for the provision of technological services, in which case the appropriate safeguards are guaranteed in accordance with the GDPR.

Personal data will be retained for the time necessary to fulfil the purpose for which it was collected and to determine any liabilities that may arise from that purpose and from the processing of the data. The provisions of the regulations in force at any given time shall apply.

  • Contact data and information requests: retained until deletion is requested, and in any case, for the applicable legal periods.
  • Customer data: during the contractual relationship and, once concluded, for the statutory limitation periods (5 years for personal obligations, 4 years for tax obligations).
  • Commercial communications data: until the user revokes their consent.

The user may exercise the following rights in relation to their personal data:

  • Right of access: to know whether their data is being processed and, if so, to obtain information about the processing.
  • Right of rectification: to request the correction of inaccurate or incomplete data.
  • Right of erasure: to request the deletion of data when, among other reasons, it is no longer necessary for the purposes for which it was collected.
  • Right to object: to object to the processing of data in certain circumstances.
  • Right to restriction of processing: to request the restriction of processing in certain cases.
  • Right to data portability: to receive data in a structured, commonly used and machine-readable format and to transmit it to another controller.
  • Right not to be subject to automated individual decisions: including profiling.

To exercise these rights, the user may contact ZENIFICA, S.L. by sending an email to comercial@zenifica.com, indicating the right they wish to exercise and enclosing a copy of their identity document.

The user also has the right to lodge a complaint with the Spanish Data Protection Agency (www.aepd.es) if they consider that the processing of their data does not comply with current regulations.

ZENIFICA, S.L. has adopted the necessary technical and organisational measures to guarantee the security and integrity of personal data, as well as to prevent their alteration, loss, unauthorised processing or access, taking into account the state of technology, the nature of the stored data and the risks to which they are exposed.

8. Amendments to the Privacy Policy

ZENIFICA, S.L. reserves the right to amend this Privacy Policy to adapt it to legislative or case law developments, as well as to industry practices. In such cases, any changes introduced will be announced on this page with reasonable notice prior to their implementation.
